An email was sent to downtown businesses on the afternoon of Friday, October 13, sharing an update from City Hall regarding the updated regulatory policy for the downtown entertainment area. The policy we’ve been telling you was going to last all summer.
The mayor’s office is shifting the landscape of downtown Orlando’s core away from clubs and nightlife into a more family-friendly, neighborhood-style neighborhood. More retail, more public parks, wider sidewalks. , and hopefully reduce crime.
To that end, they tighten up the bureaucracy to curb the “villains” and make downtown a less welcoming place to do business before sending them downstream to Main Street. Part of the change includes keeping businesses open past midnight to identify and register with the Code Enforcement Department a “person in charge” who will remain onsite during all operations while the business is open. include what you need. Ordinance No. 2022-46, Restrictions on Late Night Use in Downtown Areas
On September 26, 2022, the Orlando City Council voted to approve Ordinance No. 2022-46 regarding regulation of late night use, surface parking and noise reduction within the downtown entertainment area. Below are the new requirements for businesses within the Downtown Entertainment Area. This may include your business/property.
All late-night alcohol use in the Downtown Entertainment Area:
• A business that sells alcohol after midnight Facilities within the Downtown Entertainment Area must identify a responsible party and register with the Code Enforcement Department by November 1, 2022. Responsible Persons must remain on-site during all facility operations until closure. Companies can register their responsible persons with the Code Enforcement Department (www.orlando.gov/ResponsiblePerson).
• Promoters must obtain business tax receipts Or be an employee of the facility. To obtain a business tax receipt, visit www.orlando.gov/BTR.
• Dirt and dust must be removed Every morning before 4:00 a.m., from outside the public road in the immediate vicinity of your property.
• A business that sells alcohol after midnight All permit documents within the Downtown Entertainment Area must be kept on the property’s premises and provided to City Agents as needed. These documents must include alcohol licenses and a list of responsible persons registered with the Code Enforcement Department.NEW Late night alcohol use in downtown entertainment areas:
• Any new businesses open after midnight Use within the downtown entertainment area is considered late-night use and requires a special use permit from the organizer. For more information, visit www.orlando.gov/LateNightUses.
o A special use authorization Also required if ownership changes due to existing late night use or significant improvements.
o Review Special Use Authorization Considerations Include business descriptions, appropriate alcohol licenses, security plans, outdoor speaker identification, and site/floor plans that apply the principles of crime prevention through environmental design.Chapter 42 (Noise):
• Noise measurements on private property are measured at or beyond property boundaries.
• Indoor speakers located within 20 feet of an entrance or exit, or window or similar opening in a building, should point indoors and away from such opening.
• all New and existing outdoor speakers require planning officer decision Approve for use within the downtown entertainment area. A noise report by an independent acoustic engineer is required for existing and new outdoor speakers. To schedule an appointment to begin the process, please visit www.orlando.gov/LateNightUses.
• you must Apply by November 1st to be selected as a plannerif not, you should stop using outdoor speakers. The noise abatement recommended in that report must be completed within 60 days.
